Acceptance of Terms

Welcome to BottleNote. By downloading, installing, or using our app, you agree to be bound by these Terms of Use ("Terms"). Please read them carefully before using the app.

These Terms constitute a legally binding agreement between you ("User", "you") and BottleNote ("we", "us", "our"), the operator of the BottleNote application. If you do not agree with any part of these Terms, you must not use the app.

Note: These Terms apply to all versions of BottleNote, including the iOS and Android mobile applications, and any future platforms we may support.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the app after any changes constitutes your acceptance of the new Terms.

Eligibility

BottleNote is intended for users who are at least 13 years of age. If you are under 13, you may not use the app. In certain EU member states the minimum age is 16 years for consent-based data processing — please refer to the laws applicable in your country.

By using BottleNote, you represent and warrant that you meet the applicable age requirement in your jurisdiction. If we become aware that a user is under the minimum age, we will take steps to remove their data and restrict their access.

You do not need to create an account to use BottleNote. The app is available to all eligible users immediately upon download.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the BottleNote app on a device you own or control, solely for your personal, non-commercial purposes.

This licence does not include the right to:

Sublicense, sell, resell, transfer, assign, or otherwise commercialise the app or its content

Modify, adapt, translate, reverse-engineer, decompile, or disassemble any part of the app

Remove or alter any proprietary notices, labels, or marks on the app

Use the app to create a competing product or service

Use automated tools (bots, scrapers, crawlers) to access or extract content from the app

All rights not expressly granted in these Terms are reserved by BottleNote.

Acceptable Use

You agree to use BottleNote only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the app. Specifically, you must not:

Attempt to gain unauthorised access to any part of the app, its servers, or any connected system

Transmit any harmful, offensive, or disruptive code or content

Use the app to engage in any fraudulent, misleading, or deceptive activity

Attempt to interfere with the proper functioning of the app or its infrastructure

Copy, reproduce, or distribute any content from the app without our express written permission

Use the app in any way that violates applicable local, national, or international law or regulation

Violation: Breach of these acceptable use rules may result in immediate suspension of your access to the app, and we reserve the right to report serious violations to the relevant authorities.

App Content

BottleNote provides daily motivational affirmations, quotes, and inspirational messages (collectively, "Content"). The Content is curated and created by our team and is intended for personal inspiration and general wellness purposes only.

Not professional advice: The Content in BottleNote is not a substitute for professional medical, psychological, therapeutic, financial, or legal advice. If you are experiencing mental health difficulties, please seek support from a qualified professional.

We strive to ensure all Content is positive, uplifting, and appropriate for a general audience. We reserve the right to update, modify, or remove any Content at any time without notice.

BottleNote does not allow user-generated content to be submitted or shared within the app. All Content is provided by us.

In-App Purchases

BottleNote offers optional in-app purchases, including one-time unlocks plans that give access to premium features ("Premium"). Prices are displayed in the app at the time of purchase and may vary by region.

Billing & Cancellation: All purchases are processed by Apple (App Store) or Google (Google Play). To cancel, visit your platform's purchase management settings.

Refunds: All refund requests are handled directly by Apple or Google in accordance with their respective refund policies. We do not process refunds independently. If you have a billing issue, please contact Apple Support or Google Play Support.

Restore Purchases: If you reinstall the app or switch devices, you can restore your previous purchases free of charge using the "Restore Purchases" option in the app settings. Your Apple ID or Google account must be the same as the one used for the original purchase.

We reserve the right to modify, suspend, or discontinue any premium feature or pricing at any time. Any price changes will be communicated in advance and will not affect your current active purchase.

Advertising

The free version of BottleNote is supported by advertising. By using the free version, you acknowledge and agree that advertisements may be displayed within the app.

Ads are served by third-party advertising networks. We are not responsible for the content of third-party advertisements. If an ad links to a third-party website or app, your use of that service is governed by that third party's own terms and policies — not ours.

Upgrading to BottleNote Premium removes all advertisements and unlocks all the features.

Intellectual Property

All content, design, graphics, interfaces, code, trademarks, logos, and other materials in BottleNote are the exclusive intellectual property of BottleNote or its licensors, and are protected by applicable copyright, trademark, and intellectual property laws.

You are granted no ownership interest in any part of the app or its content. The licence described in Section 3 is your only right to use the app.

You may share screenshots of motivational content on personal social media, provided you credit BottleNote

You may not reproduce, republish, or distribute Content commercially without written permission

You may not use the BottleNote name, logo, or branding without our express written consent

If you believe that any content in the app infringes your intellectual property rights, please contact us at the address in Section 12 with full details of your claim.

Disclaimers

BottleNote is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

That the app will be available at all times, uninterrupted, or error-free

That any content in the app is accurate, complete, reliable, or suitable for your needs

That the app will be free of viruses or other harmful components

The motivational and inspirational content is provided for general informational and entertainment purposes only. We make no claims about the effectiveness of affirmations for any specific psychological or health outcome.

Limitation of Liability

To the maximum extent permitted by applicable law, BottleNote and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the app, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app in the 12 months preceding the claim, or €10, whichever is greater.

EU Consumer Note: Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under applicable EU or national consumer protection law.

Termination

You may stop using BottleNote at any time by simply uninstalling the app from your device.

We reserve the right to suspend or terminate your access to the app at any time, without notice or liability, if we reasonably believe you have violated these Terms or any applicable law.

Upon termination of your access, your licence to use the app ends immediately. Sections covering Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law shall survive termination.

Governing Law & Disputes: These Terms are governed by and construed in accordance with the laws of the European Union and the member state in which our operations are based. Any disputes arising from these Terms or the use of the app shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to the competent courts of our jurisdiction.

If you are an EU consumer, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
